BLG Argues FMLA Case Before the Fourth Circuit

BLG’s Principal Timothy Bosson appeared before the Fourth Circuit Court of Appeals to argue on behalf of their client Hannah P, a senior intelligence analyst who was denied FMLA leave. The appellate argument centered around whether Hannah was denied a position she applied for based at least in part on attendance issues caused by the Office of the Director of National Intelligence’s (ODNI) denial of leave.  Mr. Bosson contended that the government should have been required, and then failed to show that they would not have hired her regardless of the poor attendance ODNI had caused.  While an opinion is pending, BLG is hopeful to prevail on what the Chief Judge called “one of the most egregious FMLA Interference cases he had ever seen.”
