The National Vaccine Injury Compensation Program (NVICP)

Since the 1980s, nearly all claims seeking compensation for injuries caused by regular consumer vaccines have been required to proceed in the National Vaccine Injury Compensation Program, which is administered by a special set of judges (“special masters”) at the United States Court of Federal Claims.  The Program was envisioned by Congress to “provide for a less-adversarial, expeditious, and informal proceeding for the resolution of petitions” (42 U.S.C. 300aa-12(d)(2)(A)), but has transformed over the years to slow, adversarial, and quite formal litigative process. 

Fortunately, our team of attorneys have experience and expertise for litigating cases within the Program efficiently and effectively.  Our team is led by attorney Isaiah Kalinowski , who worked for the court that hears these claims for four years.  He has been representing vaccine-injured petitioners since December 2010, and has represented over 200 petitioners to date.  He is a leader in the practicing bar of attorneys that represent vaccine-injured petitioners. 

The NVICP has nationwide coverage, even though the court that hears the claims is based in Washington, D.C.  Our firm’s location in the metro D.C. area gives us proximity to the court, but we can represent your claim no matter where in the U.S. you live. 

Our firm does not require payment from our clients for our fees or for case costs during the pendency of their case, and we do not take a portion of their compensation at the end of their case.  Instead we only recover fees and costs as may be awarded by the Court.  42 U.S.C. 300aa-15(e)(3).

How Do I Know Whether My Vaccine Injury Is Compensable?

There are a few limitations to whom we can help recover compensation for a vaccine injury. 

First, and most importantly, we must be able to prove facts that connect the vaccination to the injury; however the Program is a “no-fault” proceeding that does not require that we prove wrongdoing by the vaccine manufacturer or the practitioner who administered the vaccination.  The proof required is to prove that the vaccination caused the injury, by reference to your medical records and other medical and scientific sources.  We have a great deal of experience in the effective presentation of your claim.

Second, there is a limited amount of time within which claims must be filed.  If you believe that you or someone you know has been injured by a vaccination, do not delay!  Contact us as soon as possible, since the statute of limitations imposes a strict time limit within which claims must be brought. 

Third, the NVICP does not apply to all vaccinations, but covers many of the typical vaccines administered to Americans.  A listing of all vaccines covered by the NVICP is provided here.  Most significantly, the COVID-19 vaccines are not covered by the NVICP, at least not yet.  Federal legislation has been pending for years that would provide the opportunity for compensation for COVID-19 injuries, but, at the present time, Congress refuses to act.  In the event that such legislation is ever successfully passed, people injured by COVID-19 vaccines would have a limited time to file a petition for any injuries they had suffered in the past related to those vaccines.

What Compensation Is Available If My Claim Is Successful?

The Vaccine Act provides for four categories of damages:

Out-of-pocket expenses incurred as a result of the injury, both those that have already been incurred and those that are anticipated in the future;

Lost earnings that have been suffered or are anticipated to be suffered by the vaccine-injured person as a result of the injury;

Pain and Suffering that results from the vaccine-related injury; and

Compensation for a Death that was caused by the vaccine injury.
